General Terms and Conditions (GTC) - KAISER Fanshop

1. Scope
These General Terms and Conditions (GTC) apply to all purchase contracts concluded via the KAISER AG online shop.
Where the term "consumer" is used in the following, the following applies: A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
Any reference by a buyer to their general terms and conditions of purchase or procurement shall be deemed not to have been agreed and shall therefore have no legal effect.

The KAISER online shop can only serve customers who provide a delivery address in the European Union, Switzerland, or Liechtenstein. For deliveries to other countries, anyone interested in purchasing items from the fan shop should contact KAISER AG at the following address:

3. Subject matter of the contract, order, and conclusion of the contract
The essential characteristics of the goods sold can be found in the product description and product photos.
The ordering process is initiated by selecting the desired product, quantity, and, if applicable, size. The system of the KAISER online shop at then asks a series of questions to complete the order. The ordering process is completed by clicking on "Place order." The order constitutes an offer to conclude a purchase contract by the buyer.
After completing the order, the customer receives an email with the confirmation and acceptance of the order by KAISER AG as the seller. With this email confirmation, the purchase contract has been concluded.
4. Prices and shipping costs
The prices listed in the online shop at the time of ordering apply. For customers from Switzerland or Liechtenstein, the prices are in Swiss francs (CHF), including the value added tax applicable in Switzerland and Liechtenstein. For customers in the European Union, the prices are in euros (EUR), including the sales tax applicable in the respective country of destination according to the delivery address.
The shipping costs to be charged are shown separately in the order or in the order confirmation, including the applicable value added tax or sales tax.
The VAT or sales tax amount is shown separately on the commercial invoice with the corresponding tax rate.
5. Payment
Payment shall be made exclusively in advance and in electronic form, immediately after completing the ordering process in the online shop. The following payment methods are available:
- Credit card (Visa, Mastercard)
- Apple Pay
- Google Pay
- Twint
Incorrect payments will be refunded using the same payment method.
6. Shipping
The goods will only be shipped after receipt of full payment.
If, despite full payment for the goods, immediate shipment of the goods is not possible, the buyer will be informed immediately of any possible delivery delays.
If, contrary to expectations, an ordered item is not available for delivery in the foreseeable future, KAISER AG is entitled to withdraw from the purchase contract. In this case, the customer will be refunded immediately via the payment method they selected.
If the acceptance of correctly delivered goods is refused or if they are returned, the customer shall bear the costs of shipping and return shipping. The shipping costs will be deducted from the refund of the purchase price. Notwithstanding this, the provisions under point 7 apply to consumers.
7. Right of withdrawal - Cancellation policy
Only consumers have the right to withdraw from the purchase contract within the withdrawal period of 14 days without giving reasons. The withdrawal period begins on the day on which the consumer or a third party designated by the consumer takes possession of the goods at the place of delivery.
To exercise the right of withdrawal, the consumer must withdraw from the contract by means of a clear statement to KAISER AG and communicate this statement to KAISER AG in writing by letter or email.
In the event of withdrawal by the consumer, KAISER AG will refund the payment received within 14 days of receiving notification of the withdrawal using the same payment method by which it received the payment.
In the event of withdrawal, the consumer must return or hand over the goods to KAISER AG at their own expense within 14 days of notification of withdrawal. The consumer shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.
8. Right of return, warranty
Unsuitable, incorrect, or damaged items must be reported to KAISER AG in writing within 48 hours of receipt of the goods, including a photo.
Damage to the transport packaging must be reported to the parcel delivery service upon delivery and confirmation must be requested from the parcel delivery service; if necessary, acceptance of the goods must be refused.
The statutory provisions apply to all other defects in the purchased item that occur during the statutory warranty period. Upon request, rejected goods must be returned to KAISER AG carriage paid.
9. Disposal
The fan shop's product range includes electrical appliances and devices with batteries or rechargeable batteries. We would like to point out that many countries have legal prohibitions and regulations for the disposal of electrical appliances and batteries and rechargeable batteries, which must be observed.
10. Data protection
The statutory provisions on data protection apply. Details can be found in the Privacy Policy.
11. Final provisions
The place of performance and payment is Schaanwald, Liechtenstein. The law of the Principality of Liechtenstein applies insofar as the consumer as a contractual partner does not enjoy higher protection under the mandatory consumer protection provisions of their home country. The United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (CISG) does not apply. If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Vaduz. Kaiser AG may also sue the contractual partner at any other court with jurisdiction over the contractual partner.
